We aim to maintain a safe and secure system of handling your personal individual information. For this reason, we ensure that your personal information is handled in strict compliance with the Commonwealth Government's National Privacy Principles which were passed on 21 December 2001. We only collect personal information that is necessary for us to carry on our business functions. We will only use your personal information for the reasons we collected it, which is primarily communicating with you. The User acknowledges that the use of this Site is done at the User`s own discretion and risk and with the User`s agreement that it will be solely responsible for any damage to the User`s computer system or loss of data that results from these activities.
The User agrees to indemnify Hudpac Corporation No. 2 Pty Ltd (and its employees, officers, managers, assistants, members and agents) from and against any and all claims and damages of any kind (including legal fees) arising out of or relating to your use of the Site, your breach of any provision of these Terms and Conditions and/or any intentional wrongdoing by you.
These Terms and Conditions are subject to any terms and conditions that cannot be excluded by law, including without limitation, those implied by the Trade Practices Act 1974 (Cth). In the event that Hudpac Corporation No. 2 Pty Ltd is liable for any damages arising out of the use of (or inability to use) the Site, liability is limited to the greatest extent permitted by law.
If any part of these Terms and Conditions is invalid or unenforceable, that invalidity does not affect the validity or enforceability of any other part.
Governing law and Jurisdiction
These Terms and Conditions will be governed and construed in accordance with the laws of the State of Queensland and the Commonwealth of Australia. The State or Federal Courts located in Queensland will have the exclusive jurisdiction to hear and determine any claims or disputes arising out of or relating to these Terms and Conditions.
Updating or modification of terms and conditions
South Central / The Capitol Apartments may at any time and without notice or liability to Users amend, revise or update these Terms and Conditions by posting revised Terms and Conditions on the Site. Your continued use of the Site constitutes acceptance of these revised Terms and Conditions.
All transactions are processed in Australian Dollars (AUD). All credit card transactions are processed using 128 Bit Secure Socket Layer (SSL) technology. We do not accept cash payments.
Payment in full for the booking is required when the booking is made.
Cancellations or changes to bookings must be made at least 48 hours prior to the check in date and time (based on 2pm arrival). If 48 hours prior notice is not provided, or for no shows, the entire booking amount will be payable. Please note: if you have booked a non-refundable room type, once payment has been taken the reservation is 100% non-refundable.
Valid Credit Card
You must show a valid photo ID and credit card upon check-in.
We will now be taking a $100.00 pre-authorisation via Visa, MasterCard and AMEX (WE DO NOT ACCEPT CASH). This will be used for any incidentals or mini bar charges that may be incurred throughout the guests stay. The pre-authorisation will take 5-10 business day to drop back into the guests account. Kindly present a valid credit card on arrival.
Credit Card Fees & Payments
We now have a 2% surcharge on all credit cards (Visa, MasterCard and AMEX only).
Please note our office hours are 7.00am to 9.00pm Monday to Saturday & 8.00am to 5.00pm Sunday. Public holidays reception times may vary, please contact us 07 3844 5800. If you anticipate arriving after office hours please let us know so that afterhours instructions can be forwarded by email closer to your arrival date. If you anticipate arriving earlier than the 2.00pm check in time please note that we cannot guarantee that the apartment will be available, however we will store your luggage until such time that the apartment becomes available.
As we are serviced apartments please note that a start-up pack of amenities are provided on arrival only.
Capitol Apartments Facilities Policy
All common areas including the Swimming Pool/Gym areas are used at the risk of the guest. Children under the age of 16 who are under the responsibility of the guest are only permitted to use the Swimming Pool and Gym whilst under direct adult supervision.
- Sharp objects and glass are not permitted in the common areas.
- Alcohol and food are not allowed in the common areas.
- Smoking is not permitted in the common areas.
- Users of the Pool and Spa must act in a responsible and sensible manner at all times.
- All users of the gym must carry a towel at all times and wipe down equipment after use.
- Suitable footwear must be worn to and from the gymnasium, pool and in common areas.
- Jumping, diving, running, ball playing, noisy or hazardous activities are not permitted in the swimming pool area.
- No Parties on the premises The Capitol Apartments will not tolerate parties being held in the apartments.
A party being defined as: Any situation where the maximum number of guests allowed per apartment is exceeded. Any situation where the noise level from the apartment is deemed that excessive intoxication is occurring Any situation whereby excessive traffic to/from the apartment is identified. Any situation where it is identified that excessive alcohol is present.
In the event that any apartment/guest is identified as having a party, the hotel reserves the right to immediately request all occupants of the apartment up to, and including, the guest who has registered for the apartment to vacate the premises.
In the event that an eviction does occur, the registered guest will be charged for that night’s accommodation and for any expense resulting from additional cleaning of the apartment, replacement of any furniture/fixture/fitting breakage, as well as for any required repairs.
Alcohol on the Premises
The Capitol Apartments will not allow excessive levels of alcohol to be brought on to the hotel property. Guests, visitors or any members of the public will be requested to either relinquish the alcohol to the hotel for storage until departure, or alternatively management will request that the alcohol is permanently removed off the premises.
Additional actions that may result in Eviction
The Capitol Apartments reserves the right to immediately evict any guest, visitor or member of the public for the following reasons, but not limited to:
- Intoxication and/or unsavoury/lewd behaviour
- Smoking inside any room, apartment or common area
- The throwing of objects over the apartment balconies
- Spitting over the balcony
- Wilful damage to hotel and/or resident property
- Physical or verbal assault/abuse of the hotel staff, other guests, apartment residents, members of the public on hotel premises
- Any behaviour deemed as a potential safety threat to others
- Any breach of the alcohol or party policies. Any incident for which the police are required to attend
Consequences of Eviction
In the event that an eviction of any nature occurs, the registered guest, their associates and visitors, will not be able to make future reservations at The Capitol Apartments & South Central Apartments. Should the guest fail to adhere to this request to leave premises the matter will be handed to the police.
*Any person under 18 years of age must be accompanied by an adult during their stay.
